Question by jacaxe: after 4 and a half years on SES probation and what i understood to be a “no contest” type plea i violated?
probation and my lawyer advised i could stay in county jail for an aditional 4-6 months and do a “treatment program” or plead guilty to my original charges and go to prison and be out in 2-3 months which i did. my question is this… should i have had the option to go to trial on my original charges? and shoulc i now be able to withdraw my plea based on ineffectual council? i’m out now and got another 3yrs of (now parole) for something that is not the crime i actually committed but the only one the prosecutor would allow me to accept in my “original bargain”
